End User License Agreement (EULA)

This End User License Agreement ("Agreement") is between you and HiBart ("Licensor") for the HiBart mobile application ("Licensed Application").

By downloading or using the Licensed Application, you agree to be bound by the terms of this Agreement.

1. Scope of License

Licensor grants you a limited, non-exclusive, non-transferable, revocable license to:

• Download and install the Licensed Application on Apple-branded devices that you own or control
• Use the Licensed Application for personal, non-commercial purposes
• Access features according to your subscription tier

This license does not allow you to:

• Distribute or make the Licensed Application available over a network
• Use the Licensed Application on devices you do not own or control
• Use the Licensed Application for commercial purposes without written permission

2. Consent to Use of Data

You agree that Licensor may collect and use technical data and related information—including device information, system and application software, and peripherals—to facilitate software updates, product support, and other services related to the Licensed Application.

Licensor may use this information to improve products or provide services, as outlined in our Privacy Policy at https://hibart.app/privacy.

3. Termination

This license is effective until terminated by you or Licensor. Your rights under this license will terminate automatically without notice if you fail to comply with any terms.

Upon termination:

• You must cease all use of the Licensed Application
• You must delete all copies of the Licensed Application from your devices

4. External Services

The Licensed Application may enable access to third-party services ("External Services"). You agree to use External Services at your sole risk and acknowledge that Licensor is not responsible for their content, accuracy, or your use of them.

• Firebase (authentication and data sync)
• Google Gemini AI (task processing)
• Apple services (authentication, payments, notifications)

5. No Warranty

YOU EXPRESSLY ACKNOWLEDGE AND AGREE THAT USE OF THE LICENSED APPLICATION IS AT YOUR SOLE RISK. THE LICENSED APPLICATION IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND.

LICENSOR DOES NOT WARRANT THAT:

• The functions in the Licensed Application will meet your requirements
• The operation will be uninterrupted or error-free
• Defects will be corrected
• The Licensed Application is free of viruses or harmful components

6. Limitation of Liability

TO THE EXTENT NOT PROHIBITED BY LAW, LICENSOR SHALL NOT BE LIABLE FOR ANY INCIDENTAL, SPECIAL, INDIRECT, OR CONSEQUENTIAL DAMAGES ARISING FROM YOUR USE OR INABILITY TO USE THE LICENSED APPLICATION.

In no event shall Licensor's total liability exceed the amount paid by you for the Licensed Application in the preceding 12 months.

7. Governing Law

This Agreement is governed by the laws of the State of Delaware, United States, excluding its conflicts of law rules.
