HiBart Terms of Service
Agreement to Terms
By downloading, installing, or using HiBart ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.
1. Description of Service
HiBart is an AI-powered task management application designed to help users:
- Create and manage tasks through voice or text input
- Track habits and focus sessions
- Receive intelligent reminders and suggestions
- Interact with BART, an AI assistant character
2. Eligibility
To use HiBart, you must:
- Be at least 13 years of age
- Have the legal capacity to enter into these Terms
- Not be prohibited from using the App under applicable laws
If you are using HiBart on behalf of an organization, you represent that you have authority to bind that organization to these Terms.
3. User Accounts
3.1 Account Creation
- An account is required for full app functionality
- You may sign up using email/password, Apple ID, or Google
- You are responsible for maintaining account security
- You must provide accurate information when creating an account
- One account per person
3.2 Account Security
You are responsible for:
- Keeping your login credentials confidential
- All activities that occur under your account
- Notifying us immediately of unauthorized access
3.3 Sign-In Methods
We support the following authentication methods:
- Email/Password: Traditional account creation
- Sign in with Apple: Apple's privacy-focused authentication
- Google Sign-In: Quick sign-in with your Google account
4. Acceptable Use
4.1 Permitted Uses
You may use HiBart for:
- Personal productivity and task management
- Habit tracking and focus improvement
- Voice-based task creation
- Mood tracking and journaling
4.2 Prohibited Uses
You may NOT:
- Use the App for any illegal purpose
- Attempt to reverse engineer or modify the App
- Interfere with or disrupt the App's operation
- Use automated systems to access the App
- Transmit malware or harmful code
- Impersonate others or misrepresent your identity
- Use the App to harass, abuse, or harm others
- Violate any applicable laws or regulations
- Share, sell, or transfer your subscription to others
5. Intellectual Property
5.1 Our Rights
HiBart and its contents, including but not limited to:
- The BART character and animations
- App design, graphics, and interface
- Software code and algorithms
- Documentation and marketing materials
are owned by HiBart and protected by intellectual property laws. All rights reserved.
5.2 Your Rights
You retain ownership of:
- Tasks and content you create
- Personal data you provide
- Custom configurations and preferences
5.3 License to Use
We grant you a limited, non-exclusive, non-transferable license to:
- Download and install the App on your personal devices
- Use the App for personal, non-commercial purposes
- Access features according to your subscription tier
This license does not include the right to:
- Modify, copy, or distribute the App
- Use the App for commercial purposes without permission
- Sublicense or transfer your license to others
6. Subscription and Payments
6.1 Free Trial
Trial Period: All new accounts receive a 7-day free trial of HiBart Pro features.
During the trial:
- Full access to all premium features
- No payment required
- Trial ends automatically after 7 days
- You will be notified before trial expires
After trial expiration:
- Access reverts to free tier features
- Your data is preserved
- You can subscribe at any time to regain premium access
6.2 Subscription Plans
HiBart Pro is available in two subscription options:

6.3 Premium Features (HiBart Pro)
Premium subscription includes:

- Advanced BART Interactions: Full personality and context awareness
- Smart Reminders: Context-aware notifications
- Insights & Analytics: Productivity tracking and patterns
- Cloud Sync: Access tasks across all devices
- Home Screen Widgets: Quick access widgets
- Priority Support: Faster response times
6.4 Billing and Payment
- Payment Processing: All payments are processed securely by Apple through the App Store
- Auto-Renewal: Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period
- Price Changes: We may change subscription prices with at least 30 days notice
- Currency: Prices are in USD; local currency equivalent may apply
6.5 Cancellation and Refunds
To Cancel Your Subscription:
- Open iPhone/iPad Settings
- Tap your name > Subscriptions
- Select HiBart
- Tap "Cancel Subscription"
Cancellation Policy:
- Cancel at least 24 hours before renewal to avoid charges
- Access continues until end of current billing period
- No partial refunds for unused time
- Your data is preserved after cancellation
Refunds:
- Refund requests are handled by Apple
- Contact Apple Support for refund inquiries
- We cannot process refunds directly
6.6 Free Tier
Users without an active subscription can still use:
- Basic task management (up to 10 tasks)
- Focus timer (unlimited sessions)
- Mood tracking and journal
- 1 BART personality (Friendly)
- Basic reminders
- Single device use (no cloud sync)
7. AI Features and Limitations
7.1 AI-Powered Features
HiBart uses artificial intelligence for:
- Natural language task parsing
- Smart scheduling suggestions
- BART's responses and personality
- Voice recognition and processing
7.2 AI Limitations
You acknowledge that:
- AI features may not always be accurate
- BART's suggestions are not professional advice
- AI responses are generated, not human-reviewed
- Results may vary based on input quality
7.3 Not a Medical Device - Important Disclaimer
HIBART IS A PRODUCTIVITY TOOL, NOT A MEDICAL DEVICE.
You expressly acknowledge and agree that:
- Not Medical Treatment: HiBart is NOT intended to diagnose, treat, cure, or prevent any disease or medical condition, including but not limited to ADHD (Attention Deficit Hyperactivity Disorder), anxiety, depression, or any other mental health condition.
- Not Clinically Validated: HiBart has NOT been evaluated or approved by the FDA, any regulatory body, or medical authority. It is NOT a clinical tool and has not undergone clinical trials.
- No Medical Claims: Any features described as helping with "focus," "task initiation," "time awareness," or similar are general productivity aids, NOT medical interventions. We make no claims about efficacy for any medical condition.
- Seek Professional Help: If you have or suspect you have ADHD, executive function challenges, or any other medical or mental health condition, you should consult with a qualified healthcare professional. Do not use HiBart as a substitute for professional medical advice, diagnosis, or treatment.
- User Responsibility: You are solely responsible for any decisions you make based on using HiBart. We make no guarantees about productivity improvements or any other outcomes.
7.4 Emergency Situations
HiBart is NOT equipped to handle emergencies. If you are experiencing:
- A mental health crisis
- Thoughts of self-harm
- Any medical emergency

8. Privacy and Data

HiBart integrates with third-party services:

- Firebase: Cloud storage and authentication
Use of third-party services is subject to their respective terms and privacy policies. We are not responsible for third-party services.
10. Disclaimers
10.1 "As Is" Provision
HiBart is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied, including but not limited to:
- Merchantability
- Fitness for a particular purpose
- Non-infringement
- Accuracy or reliability
10.2 No Guarantee
We do not guarantee that:
- The App will be error-free or uninterrupted
- Defects will be corrected
- The App will meet your specific requirements
- Data will never be lost
10.3 Use at Your Own Risk
You use HiBart at your own risk. You are responsible for:
- Backing up your data
- Verifying important information
- Using the App responsibly
11. Limitation of Liability
11.1 Exclusion of Damages
To the maximum extent permitted by law, HiBart and its affiliates shall not be liable for:
- Indirect, incidental, special, or consequential damages
- Loss of profits, data, or goodwill
- Service interruption or system failure
- Any damages exceeding fees paid in the last 12 months
11.2 Essential Purpose
Some jurisdictions do not allow limitation of liability for certain damages. In such cases, our liability is limited to the maximum extent permitted by law.
12. Indemnification
You agree to indemnify and hold harmless HiBart and its affiliates from any claims, damages, losses, or expenses (including legal fees) arising from:
- Your use of the App
- Your violation of these Terms
- Your violation of any third-party rights
- Content you create or share through the App
13. Modifications to Terms
We may modify these Terms at any time by:
- Posting updated Terms in the App
- Notifying you via email or in-app notification
- Updating the "Last Updated" date
Continued use of HiBart after modifications constitutes acceptance of the updated Terms. If you disagree with changes, you must stop using the App.
14. Termination
14.1 By You
You may terminate your use of HiBart at any time by:
- Cancelling your subscription (via App Store settings)
- Deleting your account (in app settings)
- Uninstalling the App from your devices
14.2 By Us
We may suspend or terminate your access if you:
- Violate these Terms
- Engage in prohibited conduct
- Fail to pay subscription fees
- Are inactive for an extended period
- Abuse our services or support
14.3 Effect of Termination
Upon termination:
- Your license to use the App ends
- You lose access to premium features
- Subscription charges stop (no refund for current period)
- Account data is deleted immediately; cloud data is purged within 30 days
- Provisions that should survive termination will remain in effect
15. Dispute Resolution
15.1 Informal Resolution
Before filing a formal dispute, you agree to contact us at legal@hibart.app to attempt resolution.
15.2 Arbitration
If informal resolution fails, disputes shall be resolved through binding arbitration, except for:
- Small claims court matters
- Intellectual property disputes
- Injunctive relief for ongoing violations
15.3 Class Action Waiver
You agree to resolve disputes individually and waive the right to participate in class actions or class-wide arbitration.
16. General Provisions
16.1 Governing Law
These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles.
16.2 Severability
If any provision of these Terms is found unenforceable, the remaining provisions will continue in effect.
16.3 Entire Agreement
These Terms, along with the Privacy Policy, constitute the entire agreement between you and HiBart.
16.4 Waiver
Our failure to enforce any right or provision does not constitute a waiver of that right.
16.5 Assignment
You may not assign these Terms without our consent. We may assign our rights freely.
